7. Data Use & Compliance

UOM collects and processes personal data solely for providing immigration advisory services and maintaining client records. For users subject to GDPR (EU/EEA) or CCPA (California), we implement additional protections including: data minimization principles, right to access/delete personal information, and opt-out mechanisms for data sharing. Financial documents and sensitive materials are encrypted during transmission and storage. We may share information with authorized third parties only when necessary for case processing (e.g., translation services), under strict confidentiality agreements. All data retention follows a 7-year policy post-case closure to comply with U.S. document retention requirements. International data transfers utilize GDPR-approved safeguards for EU clients. California residents may request disclosure of data categories collected and opt out of sale (though we do not sell personal data).

8. Intellectual Property Rights

All content, materials, and resources provided through UOM's services, including but not limited to website content, application templates, case preparation materials, training documents, and proprietary methodologies ("UOM Materials"), are protected under international copyright, trademark, and other intellectual property laws. UOM retains full ownership of all UOM Materials, which are provided to clients solely for personal, non-commercial use in connection with their immigration applications.

Clients are expressly prohibited from: reproducing, distributing, modifying, or creating derivative works from UOM Materials; using any content for commercial purposes or third-party benefit; reverse-engineering any proprietary systems or processes; or removing copyright/trademark notices. The "UOM" name, logo, and all related branding elements are registered trademarks that may not be used without express written permission.

While clients retain ownership of their personal documents and application materials, any feedback or suggestions provided to UOM regarding our services or materials may be incorporated into our proprietary systems without obligation or compensation. Unauthorized use of UOM's intellectual property may result in immediate termination of services and legal action to protect our rights.

This comprehensive protection extends to all digital and physical formats of our materials, including web content, printed documents, and electronic communications. By using our services, clients acknowledge and agree to respect these intellectual property rights in their entirety.

9. Third-Party Links

Our website and materials may contain links to third-party websites, government portals, or service providers for your convenience and reference. These external resources are provided solely as supplementary information and do not imply endorsement, partnership, or responsibility by UOM. We carefully select reputable sources, including official U.S. government websites (e.g., USCIS, Department of State), accredited financial institutions, and recognized legal organizations.

However, we cannot guarantee the accuracy, completeness, or timeliness of content on external sites, as these are beyond our control. When accessing third-party links, you will be subject to their respective terms and privacy policies. We strongly recommend verifying all critical immigration information directly with official government sources before making decisions.

UOM expressly disclaims liability for any damages, losses, or consequences arising from your use of or reliance on third-party content, services, or transactions. Should you encounter broken links, outdated information, or questionable content on any linked resources, please notify our support team for review.

10. Disclaimers & Service Limitations

UOM provides advisory services for informational purposes only and makes no representations or warranties regarding visa approval outcomes. While we employ experienced consultants and maintain current knowledge of immigration procedures, we expressly disclaim any guarantee of application success, specific processing times, or particular case results. U.S. immigration decisions remain at the sole discretion of government authorities (USCIS, DOS, CBP) and are subject to changing regulations, administrative processing, and individual officer review. Our success rate statistics, when referenced, reflect historical client experiences and cannot predict future results.

We do not control or influence: Government adjudication standards, visa quota allocations, security check durations, or consular interview outcomes. Clients should understand that even properly prepared applications may face requests for evidence (RFEs), administrative processing, or denial based on factors beyond our control. No refunds will be issued based on case outcomes. For legal assurances, clients must consult licensed immigration attorneys. This disclaimer constitutes an essential term of our service agreement.

11. Limitation of Liability

To the fullest extent permitted by law, UOM shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from or related to our advisory services, including but not limited to: visa denials, application delays, financial losses, or missed opportunities. Our aggregate liability for any claims shall not exceed the total fees paid for the specific service in question. This limitation applies regardless of the legal theory (contract, tort, or otherwise) and even if advised of potential damages.

UOM expressly disclaims liability for: (1) actions or omissions by government agencies; (2) client-provided inaccurate or incomplete information; (3) force majeure events; (4) unauthorized account access; and (5) third-party services. Clients acknowledge that immigration processes involve inherent uncertainties, and our advice represents professional judgment, not guarantees. Some jurisdictions do not allow certain liability limitations, so these provisions may not fully apply to you.

12. Termination of Use

UOM reserves the right to suspend or terminate services immediately if: (1) you violate these Terms; (2) provide false information; (3) engage in fraudulent activity; or (4) fail to make required payments. Termination may occur without prior notice at our sole discretion. Upon termination: all outstanding fees become immediately due, your access to client portals will be revoked, and we may retain your documents as required by law.

You may discontinue services by providing written notice, though paid fees remain non-refundable except where expressly guaranteed. Partial service completion does not entitle you to proportional refunds. Following termination, UOM will maintain your records for 7 years per document retention policies, after which we may securely destroy them.

Termination does not relieve you of outstanding obligations, including payment of accrued charges. We may report suspicious activities to relevant authorities when warranted. These termination provisions survive the end of our service relationship.

13. Force Majeure

UOM shall not be liable for any failure or delay in performing our services due to circumstances beyond our reasonable control, including but not limited to: Government shutdowns, changes in immigration laws or policies, natural disasters, pandemics, acts of terrorism, war, labor disputes, internet/telecommunication failures, or other extraordinary events ("Force Majeure Events"). During such events, our service obligations will be temporarily suspended until normal operations can reasonably resume.

Clients will be promptly notified of any Force Majeure Event impacting services. If the disruption continues beyond 60 days, either party may terminate the affected services without penalty, with refunds issued only for prepaid but unperformed services. You acknowledge that immigration processing delays caused by government agencies during Force Majeure Events do not constitute a breach of our agreement. This clause does not relieve clients of payment obligations for services already rendered.

14. Changes to Terms

UOM reserves the right to modify these Terms at any time to reflect changes in our services, legal requirements, or business practices. Material changes that affect your rights will be communicated through prominent website notices and/or direct email notifications at least 30 days before implementation. Non-material adjustments may take effect immediately upon posting.

Your continued use of our services after any modification constitutes binding acceptance of the revised Terms. If you disagree with substantial changes, you must discontinue using our services within the notice period. We recommend periodically reviewing this section for updates. Archived versions of previous Terms will remain accessible for your reference.

No oral modifications or side agreements shall be valid. All amendments must be in writing and executed by authorized UOM representatives. In case of conflicting terms between versions, the most current published Terms shall prevail.

15. Governing Law & Dispute Resolution

These Terms and any disputes arising out of or relating to your use of our website or services shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

In the event of any dispute, claim, or controversy between you and UOM related to these Terms, both parties agree to first attempt to resolve the matter amicably through good-faith discussions. If a resolution cannot be reached within 30 days, the dispute shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Los Angeles, California, and the proceedings shall be conducted in English.

Each party shall bear its own costs, and the decision of the arbitrator shall be final and enforceable in any court of competent jurisdiction. By agreeing to these Terms, you waive your right to pursue any claims in court or to participate in a class action, to the maximum extent permitted by law.
